You ("Member") agree to all terms and conditions of this Agreement and represent, on behalf of you, your company (including any predecessor entities of your company), employees, and any individuals performing work on your behalf, at the time you become a PoweredByPros customer, and thereafter while this Agreement remains in effect, as follows:
All PoweredByPros payment transactions are solely for purchasing credits ("PoweredByPros Credits") and nothing more. Once these credits have been loaded into the Member Account, it will be considered that the service has been received. These credits may be used by Member for purchasing "Leads". PoweredByPros may also charge certain Fees ("Penalty Credits or Fees") for fraud, misconduct or other violations of these Terms, as determined in our sole discrection.
Once a project's contact info has been loaded into the Member Account and appears in the Transactions section of the Member Account, it will be considered that the Goods/Services have been completely received.
You agree to pay all applicable Fees or charges based on the Fee and billing terms then in effect, regardless of whether you have an active Account. Charges shall be made to your credit card, PayPal or other payment method designated at the time you make a purchase. If you do not pay on time or if PoweredByPros cannot charge a credit card, PayPal or other payment mehtod for any reason, PoweredByPros reserves all rights permissible under law to recover payment and all costs and expenses incurred, including reasonable attorneys' fees, in our pursuit of payment. You explicitly agree that all communication in relation to delinquent accounts or Fees due will be made by electronic mail or by phone. Such communication may be made by PoweredByPros or by anyone on its behalf, including but not limited to a third-party collection agent.
All refund requests will be subject to PoweredByPros’s review and absolute discretion and All Sales Are Final. We will normally process your valid written request within thirty (30) days of receiving it. Refund requests must occur within 72 hours of the purchase of a Lead. Refund requests will not be accepted for all leads that have been purchased after 72 hours of the Lead entering the system. All "Storm/Water Restoration" Lead(s) purchased 24 or more hours from the date of the Lead entering the system are non-refundable. If a Customer signs a contract with another User that purchased the same Lead, that Lead becomes non-refundable. All refund request must occur through the User's account at https://www.pbtpleads.com/ then by visiting the users Transactions section of their account settings. If the "Refund?" button does not appear it means that is is past the 72 hour rule and cannot be refunded. All "Duplicate Lead" Refund requests must be submitted with proof of "Date of Reception" from source that is other than PoweredByPros. All "Duplicate Lead" Refund requests will be rejected if the "Date of Reception" from outside source is after the "Date of Reception" from PoweredByPros. All refund requests for incorrect category or job too small will be rejected if purchase was not an "Auto Purchase".
All refund request for purchases of "Credits" will be subject to PoweredByPros's review and absolute discretion. All Credit refund requests will be subject to a deduction equal to all credits received by PoweredByPros.
Your purchase or receipt of PoweredByPros Credits represents the purchase and receipt of service from PoweredByPros and can be used by you to receive certain services on the Platform, including the purchase of Leads that contains potential customer information. We will always be transparent with you about the number or range of PoweredByPros Credits you may use to access certain information. PoweredByPros Credits have no monetary/cash value and your purchase or receipt of PoweredByPros Credits does not represent a pre-funding of stored value that can be accessed or used in the future for any purpose. You agree that all sales of PoweredByPros Credits are final and non-refundable.
Furthermore Member understands acknowledges and agrees that all sales are final. In addition Member agrees that PoweredByPros is not responsible for who chooses to become Member's customer that this service does not guarantee that Member will generate new or increase business.
Payments by eCheck.Net that are returned will incur the User of a fee that is work 2 times the Lead cost.
Authorize.net declined charges that are authorized due to a bug in the system, will have the funds withdrawn from their account at the sole discrection of PoweredByPros.
Users with a negative balance for over 90 days will be subject to collection efforts based on PoweredByPros discrection. In addition the User agrees that every 30 days with a negative balance, a fee of $10 will be accessed to the Users account.
ACCOUNT SUSPENSION / TERMINATION / CANCELLATION
At PoweredByPros our goal is to provide you with the best projects in the industry. All of our contacts are phone verified by one of our agents prior to sharing the info with your company. This means, that every customer receives a phone call to go over briefly over the project and confirm the customer’s personal information.
Pausing you account is available at any time from the user dashboard. Once account is paused, you will stop receiving any new project notifications for a 14-day period. You can also contact your assigned account manager at any time to request to pause or cancel your account.
We may, in our discretion, with or without cause, with or without prior notice and at any time, decide to limit, block, suspend, deactivate or cancel your PoweredByPros account in whole or in part. If we exercise our discretion under our terms to do so, any or all of the following can occur with or without prior notice or explanation to you: (a) your Account will be deactivated or suspended, your password will be disabled, and you will not be able to access the Platform or your user Content, or receive assistance from PoweredByPros support teams; (b) if appropriate in our sole discretion, we may communicate to you that your Account has been terminated, blocked, suspended, deactivated, or cancelled, and why this action has been taken. You may cancel your use of the Platform and/or terminate your Account at any time by sending written notice to email@example.com or by mailing us at PoweredByPros - 20335 Ventura Blvd #400, Woodland Hills, CA 91364. Continued access to the PoweredByPros platform, whether on the website or mobile app or any other platform will nullify all cancelation requests prior to that date and up to the last date of platform access.
